Legislation and Legal Opinion Commission - Councils

Council of the Commission

Formation:

It is formed under the chairmanship of President of the Commission and the membership of the vice president and the directors of the four technical departments.

Competencies:

  1. Drafting regulations and decisions related to the Commission.
  2. Supervising the proper functioning of the Commission.
  3. Proposing the Commission's budget and approving its final account.
  4. Approving postgraduate training or study programs for members.
  5. Approving members' sufficiency reports and deciding on grievances raised about them.
  6. Proposing the appointment and promotion of members, renewing and terminating contracts of non-Bahraini members, and all matters related to them, and deciding on the transfer, secondment, and loan of members, and all other matters presented by the President to the Council.

Council of Opinion and Legislation

Formation:

It is formed under the chairmanship of President of the Commission and the membership of the Vice President and a sufficient number of the Commission's Counselors

Meetings:

As needed

Competencies:

The Council of Opinion and Legislation is responsible for deciding on the following matters:

  1. Disagreement over the interpretation of a provision in laws or legislative decrees between the government represented by the Cabinet and the Shura and Representative Councils or one of them, or between the two councils. The decision issued shall be reasoned and binding on the parties if it was issued at their request.
  2. Disagreement between ministries, institutions, or public bodies or between these entities and each other, after the approval of the Cabinet, as well as disagreement between independent bodies regulated by law or between them and other ministries, institutions, or public bodies. The decision issued in these cases shall be reasoned and binding on the parties if it was issued at their request.
  3. Issues where one department of the Commission holds an opinion that contradicts a decision issued by another department or by the Council of Opinion and Legislation.
  4. Reviewing draft laws, legislative decrees, decrees, regulations, and other issues and topics referred to by the Commission’s President.
