“Legislation and Legal Opinion” signs a Memorandum of Judicial and Legal Understanding with the Egyptian Council of State
The Egyptian State Council and the Legislation and Legal Opinion Commission have concluded a memorandum of judicial and legal cooperation, the first of its kind in the history of the State Council, on Bahrain's initiative, with the aim of supporting cooperation in the field of academic training with an applied dimension for the proper judicial and legal preparation of technical members of both parties.
The memorandum was signed in Manama at the headquarters of the Commission between the President of the Egyptian Counselor Dr. Mohammed Masood and President of the Legislation and Legal Opinion Commission, Counselor Abdullah Al Buainain.
The signing of the memorandum is part of the parties' desire to strengthen judicial and legal cooperation between them by sharing experiences, intellectual enrichment and active participation of both sides in order to enhance judicial and legal work at the academic, training and professional applied levels.
The MOU also aims at facilitating communication between the parties for the exchange of information and knowledge in the legal field, in particular training to achieve the parties' aspirations to refine the skills of professional members at the applied level, and to improve the legal and judicial work system of the parties through the holding of workshops, seminars and conferences relevant to the practical realities of our Arab judicial bodies.
It also aims to promote the dissemination of comparative legal thinking, and to establish an applied theoretical legal information base aimed at disseminating research, articles and comments on judgements by the parties' leading technical members.
The memorandum also seeks to establish an electronic information base "in the long term", which will serve as a nucleus for daily electronic communication between the two parties so that each other's professional members can keep abreast of all judicial and recent developments in the field of advisory, and new legislation immediately and directly upon its promulgation, thus achieving continuous communication and full coordination in judicial and legislative directions.
The President of the Egyptian State Council said that Bahrain's initiative, represented Legislation and Legal Opinion Commission, to build bridges of cooperation and coordination with the Egyptian State Council in the interest of both parties.
He commended the Legislation and Legal Opinion Commission and its judicial and legal role, noting that the role of legal advisory opinions was at the same time extremely important and dangerous. It was therefore determined whether or not the State followed the principle of legality in its actions and behaviors and within the framework of the law.
He stressed that the Egyptian State Council, as well as the Legislation and Legal Opinion Commission, represent, through their general competencies, specifically what is related to expressing legal opinions, preparing and drafting legislation, and reviewing international contracts and treaties, the responsible advisor to the administration. They are the protectors of legitimacy and the rule of law, and they are also entrusted with preserving the public interest. At the same time, they are also the ones who watch over the rights and freedoms of individuals, ensuring that the administration does not infringe on them without legal support or justification.
He stated that judicial and legal cooperation with the Commission includes many initiatives and coordination steps, including training Bahraini advisors in the Commission and enrolling them in specialized training courses organized periodically by the State Council for judges and advisors.
The President of the Egyptian State Council pointed out that the Council, with its extensive experience and distinguished judiciary, is pleased to contribute to transferring its experiences, history and knowledge to its brothers in Bahrain, represented by the Legislation and Legal Opinion Commission.
He pointed out that this matter is considered a duty for him and out of awareness of his pioneering role in the field of administrative judiciary and legal opinions in the Arab world, and that the Council has contributed to laying the foundations related to judicial principles through the expertise of its advisors, who have become the subject of constant demand from various Arab countries to benefit from extensive experience.
He thanked Counselor Al Buainain for his effective efforts and his push for the bonds of judicial and legal cooperation between the two brotherly countries, represented by his generous initiative to sign the memorandum of judicial and legal cooperation to move forward with more effective and positive steps to achieve the greatest benefit for the two brotherly countries.
Meanwhile, the President of the Legislation and Legal Opinion Commission said that the memorandum of understanding concluded with the Egyptian State Council will open broad horizons for benefiting from the long-standing expertise of the Egyptian State Council.
He stressed that the Egyptian State Council took upon itself the task of establishing the advisory role as a faithful advisor to state institutions by exercising the tasks of legal advisory opinions, preparing and drafting legislation, and reviewing contracts, as the Council can be considered without dispute the founder of this advisory role and of the administrative judiciary in general in the Arab world and not in the Republic of Egypt. The solid principles he concluded were the ones that defined and set the parameters for the important advisory role of all the bodies that were later established in his footsteps in the Arab countries.
Al Buainain thanked the President of the Egyptian State Council for his supportive role in signing the memorandum of understanding and approving the initiative of the Legislation and Legal Opinion Commission to take ambitious steps to enhance bilateral work between the two parties.
